ok.......as u all know daddy was in the nursing home.......had lots of dr bills before going to nursing home......

i had to go to medicaid after daddys medicure..had paid all they would pay.......it took me 3 trips to get all the paperwork

straight...so in the end i guess medicaid.........only paid out almost 10,000 for his care............

i paid about 9000 out of his account.........and of course nursing home got his social sec checks every month

daddy owed nothing on his house............no taxes..no loans ..nothing.............

so now that he is gone.....medicaid sent me a letter saying they will take the property.....unless we protest it ..with papers for a underage child,

blind,disabled child.......ect....or if we want to pay.....the $10,000 we can keep the property
i wondering............if anyone has delted with this kinda thing.............

if i pay the medicaid back their money......lawyer says ..all i have to do is get everyone to sign the paper work and i could have it free and clear by paying the $10,000

my question is........can something else put a claim on it.......like the nursing home? lawyer says......nursing home and medicaid is connected...and they cant..........but i dnt want to drop that kinda money not knowing if im gonna lose it or not 1|1|I deal with this often.......more often than I would like to|kdrink|kdrink34@yahoo.com|23:35:15|06/04/2012|

If your DAD owes the nursing home absolutely nothing then the bill is settled and paid in full. You need to check with the nursing home's financial office. Nursing homes are privately owned and hold a certain amount of beds for Medicaid clients. They are connected for billing purposes, but not one in the same. They take a Medicaid rate for payment, but I would make that phone call to their financial office. I can tell you stories, but it's very important that you do this AND ASK THEM TO SEND YOU SOMETHING IN WRITING! ( saying that his final bill is zero) AND IF THEY ARE IN YOUR AREA OFFER TO GO PICK IT UP AND DO SO, run don't walk.

Re: Medicaid, yes they are entitled to your dad's house. it's part of the paperwork fine print (called recapture)that was signed. If you pay the bill then they go away. It's that simple. BUT........

I am not sure what state you are in, I would question the atty as to if your Dad had a Will that left the house to you and your siblings, how that (if you pay the 10k) entitles you to 100% ownership of the home? In my state it would only entitle you to 10,000 more than your siblings when the home is sold. If that's what you meant by "free and clear"

If he didn't have a Will then that's another story.

You said that your Dad had a lot of Medical bills, yes?

Are any outstanding? Medicaid only has a 3 month pay back, meaning that if you incur medical bills in January and apply and get Medicaid granted in June, Medicaid will only pay medical bills for June, May, April, and Feb. Leaving January and any previous month going unpaid by Medicaid.

Medicare is always the primary insurance with Medicaid being the secondary. Did your Dad have Medicaid while he was ALWAYS in nursing home care? People often assume that just because the nursing home get the SS check, there is not an outstanding bill. It may not be the case. It happens more often than you think that people do infact have a balance at the nursing home even with Medicaid.

3|3|Exellent info, Kathy.....you answered some questions I've had over the years on that all works, and I've been in longterm care for 18 yrs! :) I would also add that Medicaid is MONTHS behind paying the nursing home...but the billing is done monthly as far as I understand. SO, if the nursing home has billed for previous months prior to your dad passing away but hasnt been paid by Medicaid yet, don't let them bill you for that! this would be things like a haircut, copayments, hair care items, HBA. Some of these items are the persons responsibility to pay, not Medicaid or Medicare.

Re: Medicaid billing, if your state is behind in payment, you will need to contact Medicaid directly to see if whatever service that is being billed would in fact be paid by Medicaid. With the limited info as to how many months your dad was in the NH and how long he had Medicaid, it is hard to say, but if they are months behind I'd contact them.
