Ok I sold an expensive Sonic Toothbrush on there for 71.99. She used Buy-it-now. I don't like selling electrical stuff because they can switch stuff and say it doesn't work (have had it happen before). This was sold with hard plastic that you have to cut open to get out. I sent it insured. Anyway 2 days after she received it she wrote me and said she wanted to return it because the plastic was cut open and someone must have damaged it that maybe I had a friend send it and they did it. She said it came to her fine the box was not opened so this wasn't done by the post office and I know it was in perfect when I put it in the box and sent it so she must be running a scam on me. My question is if I don't refund her money and she files a "Item not as decribed claim" will she win? I have pictures of what it looked like and it was completely sealed. I was told by someone that ebay and paypal almost always side in favor of the buyer. Should I even try to fight this or should I at least try? If they side against me it also goes against my account. I don't know what to do. This person also has a feedback rating of 14 and hasn't bought anything in at least 6 months. Any advice greatly appreciated. Thanks so much! A couple of questions for you.... Did you have pictures in the actual listing of both sides of the package showing that it wasn't cut? Did you respond to her email yet? Did she file a dispute yet with ebay or paypal?

While ebay and paypal generally do side with the buyer, ebay recently started settling some of these disputes with money out of their own pocket....so it might be worth it to dispute it if she opens a dispute.

The downside to allowing it to go to dispute is the potential risk of a negative and/or a strike against you. One negative and/or strike isn't likely to harm you, but it depends on how much selling you do on ebay and how important it is to you to keep a good standing.

It just gets me sick that the seller seems to have no right. To me this is an out and out scam but ebay will probably still side with her. it's crazy and I'm seriously thinking of not selling on there anymore. One will not really hurt you. She will probably file a complaint and they will "freeze" your paypal payment. She will probably get her money back and they will deduct it from your account. Atleast she will know you saw through what she was doing and know that you know she was not honest. (Maybe she will feel bad about it. Probably not!) I would also make her send you something back. Even if it is not your item at least she will have to go to some trouble. That is my opinion on how I would handle it. Just wanted to let you know. 6|1|I sold a glass cake tote in perfect condition years ago on ebay. The buyer complained that there was a small chip in it. I think he was trying to scam me. I told him to take it to the Post Office as it was insured and make a claim. I never heard from that person again. I didn't have paypal at the time, still don't. They never left negative feedback. I called their bluff.

It is worth a try, you have nothing to lose. I hope things work out for you. You are such a nice person, a good trader and you don't deserve this problem.
