we filed ch 7 as we don't own or pay for the house we live in
we learned our lesson with tooo much debt

especially having going through a divorce 2 yrs ago, spinal surgery last year, car repo during divorce process and now living off one income and still raising 4 boys, I am overwhelmed with debt, had wage garnishments and even working fulltime as a nurse, after I pay rent, gas bill, electric, water bill, cable/internet, gas to get to work, I barely have enough if any left to get enough food for my boys , much less try to catch up on bills. I dont have anything that they can take...i have nothing of value, not even a car. sad,really. I just dont think that I can come up with the money to pay a lawyer to help me do this. 4|3|I would say go talk to a lawyer.... it sounds like it would definitely be an option for you. Not only is the bankruptcy on your credit report from the 1st day it is filed, it is on your cc report for 7 years AFTER the discharge date. So if you file a 13 and pay on it for 5 years the bankruptcy will be on your credit report for a total of 13 years not just 7. But seeing as you say you have nothing of value, you should be able to go with a 7 making it about 7 1/2 years on your credit report. Also, heed to the judge's orders...... if he tells you not to get a cc for so many years do exactly as he says because if something comes up with your case later and it is found out that you did anything you were specifically told not to do by the judge they can throw the whole thing out and you can be responsible for any accruing interest on the accounts from the time of the original judgement to the time of the new judgement. I filed a 13 in 1993 and it was over $900.00 (went into the 13) but then it had to be converted in 1998 to a 7 and that legal bill was over $700 and I had to pay it out of pocket UPFRONT.
