Ok..soo in divorce ex was court ordered to pay the ONE bill 'he' ran up..visa. However it was in my name originally but some years back he was added on to it. He remarried..going thru a consolidation company as he has bills from his new wife and can't affored to pay (but she is expecting new baby soon ..go figure, huh). Long story shorter, the bank is rejecting the consolidation companies offers so far (they said that is not unusual) and he has made 2 pymts to the company. However, it's hurting 'my' credit score. I have been trying to refi this home (court said 2 yrs to refi or sell) and now can't do it as my name on this card and the visa people not getting the payments yet have lowered my credit score as well as his. Said court order is 'civil' and I am still legally responsible. Geez...can I get cut a break here?! I told him it's his fault I can't get it refi'd and I am NOT selling (won't get enough in this current market for it to get anything else after sale and we have to have a place to live. My pymt is cheaper than renting by a long shot in this area) and it's 'his' fault my credit is now crappy so can't refi,so tough..am staying here. He says 'he knows' it's his fault.
Does anyone know how I can get my name off that card legally and not be responisible for it? What good is a court order if it's not going to be legally binding? I am sooo upset/depressed/mad over this. I could really use the refi to lower the pymt right now etc. Appreciate any advice on this situation. thanks!!

I had this happen to me. I just simply requested a hearing with the Judge on the case explaining my situation. I got the court hearing and the Judge made it court ordered that my ex was to pay all expenses and that my name was to be removed from the debt. My lawyer sent the paperwork to credit card company. They said they couldn't do that and the lawyer said fine we will take you to court. The following month my name was removed. I never seen a bill from them after that and it was removed from my credit report. I hope this help some. then you can probably take him back for contempt of court. He was ordered by the judge to pay it and didn't. You probably need a lawyer, but often judges are willing to order the ex to pay your court costs for having to take him to court.
You could try what they mentioned above. It might help to send send a copy of the order and a letter of explanation to your credit reporting companies so that they can log it. They generally have a way to let you plead your case in the notes.
Also, he should have found a way to get your name off the account as of the date of that order. My sister's EX was really bad about this and she still has crap from him haunting her report. If you used an attorney for the divorce, go back and talk to him. Sorry your ex is a jerk.

Court kept telling him he had to pay but he didn't & nothing was ever done about it. You cannot get your name off this card, she tried & tried. So finally she called the card company & told them what was going on & they finally accepted a much smaller amount so she could get this cleared up. When you speak with the refi company have this information that they have accepted an amount & you will allow the refi company to pay Visa first & it might go through this way. This is what my neice had to do & it was cleared up & paid off & she got her credit straightened up. Visa only wants their money, so they will usually work something out with you. Or have your lawyer contact them so it's legal & binding. Hopefully this will work for you & you can get your life straightened up. Hope this helps some.

The visa and consolidation company knows all this info..makes no difference. I talked till I am blue in the face to no avail. Just talked to ex and he said the consolidation company says 3 pymts have to be made usually before the credit card company will sign and accept their terms for pymt and he said next pymt (3rd) comes out tomorrow. Soo told him to dog them and be aggressive and let me know what happens with the cons.company & visa. Hopefully visa will accept it after this pymt. There is no way I can afford a lawyer again..barely making it now. Money I got from tax refund and payoff of totaled car got me another car which I needed VERY badly as I need a back up for my special needs girls..could cost them their lives if I didn't have readily available running transportation. Yes..car was paid for ..can't afford pymts on a newer car either. Ex lives other side of the country so not even in this state so doubt anything would come of it. Please pray that visa will quickly accept the contract so my credit can be built back up again after this fiasco.
