hi all, do we have any legal minds from il on here? have a question ~ my cousin (the one who lost her 3 year old son to a drowning in june) had her husbands truck stolen last night. they have a family truck that has full coverage but the truck that got stolen just had liability. it was towed from the crime scene and is now on the tow truck drivers property. long story short ~ she has a tow truck bill and the lot owner is going to charge her $40 a day "storage" ... i work in law enforcement myself but the extent of my knowledge ends when the truck is being towed away ... i don't know about the billing or the storage fee. does anyone know if this is legal ~ for them to have to pay the storage fee, i mean.

she checked with their insurance to see if the liability would pay since it was stolen but the agent told her no on that, on the tow bill and on the storage.

dangit ~ sounds like she is going to be financially responsible for it, doesn't it?! any ideas from anyone about if she can haggle with the lot owner on a price? i know he's a working man, too, and is just trying to make a living but this family just lost one of their sons on 06/14 to a drowning and had the funeral expense, lost wages and now this ... I talked with the manager at the lot that tows for the county where I work in Missouri. when I call for a tow i just call dispatch and they relay the call to the tow service meaning it's a police authorized tow and not an owner authorized tow ~ unfortunately lots of vehicles he tows are at his own expense (county's really as they pay but usually the owner doesn't). he said he sometimes works out deals with owners of towed cars where he waives the fee and they in turn "sell" him the car for the fees so the owner doesn't owe anything and he can part out the vehicle and make some money that way. is that standard practice all over or just here in missouri? thanks in advance, for the advice ~ 5|1|They pay the fees and can try and recoup the money a couple of ways|tollman62|thebossatnight@yahoo.com|16:27:04|07/28/2010|

if the state has a crime victims compensation board they may get some money back trhough that. If the criminal was caught civil suit against them for damages and fees drpending on the amount they might be able to do this in small claims. Usually if someone signs the title over against the fees of the tow service the vehicle is a junker to begin with.

my cousin knows of one of the little boys (both were 15) who did it ~ i guess the parents are on state assistance and don't own anything that they could attach. i think she said they had, "no recoverable income" or something like that ... 9|1|Link inside for Crime Victim's Compensation in Illinois. I wonder if a third party (a family member perhaps) could talk directly to the owner of the lot and see if they will work with you on a fair price? Obviously your cousin is not in any shape to have to explain to a stranger what she has just been going through (and I am so sorry to hear that by the way) and I am thinking that maybe if someone can let that business owner know, perhaps they will negotiate. I do know that almost anything is negotiable if you can get to the right person and talk them into it, especially with individual businesses.

that sounds like a good, reasonable, plan. they are from a small community and all that's happened to her family has been on the news and in all the newspapers, etc. i'll bet he would ~ maybe their pastor will be a 3rd party negotiator for them. she's just about to "lose it" though. she was holding together pretty good, i thought, after jon-jon drowned last month. they have 3 other boys and she was "holding it together for them" as she put it. this has pushed them all close to the edge, though. thanks again ~ sandy 13|3|You're very welcome. i agree with you. like i said in one of my earlier posts, i work in law enforcement. when i call for a tow i secure the vehicle and send it on it's way. i never realized about the fees until i started asking around after this happened. i think i had written, also, that this was the 2nd vehicle the juveniles had stolen that night. at 0200 they stole a vehicle from the front yard of a previous police chief. they totaled that one and at 0400 they stole my cousin's husband's truck. they left a path of destruction that is just a shame. the first vehicle, this vehicle and this chase ended at the "far end" of a corn field so i can imagine what the crops look like now. just a shame and these kids were only 15 years old! maddening, isn't it?!
