My son bought a refurbished Xbox360 on ebay (BIN), it came with a 90day warranty. He got the item yesterday, set it up, and it isnt reading the game discs. After trying some troubleshooting, it still isnt working. I contacted the seller to make arrangements for an exchange or repair, and he replied quickly, gave instructions with an address to mail it.
Now, my question is this: Is it unreasonable for me to expect the seller to pay for return shipping since the console did not work upon recieving it? This wouldnt really fall under the warranty aspect as it arrived in non-working order.

Thanks for any input, I'm arguing nicely with him at this point for him to pay the shipping, but want to know my options.

do not think that is unreasonable at all, especially if the item does not work. ebay will back you up on this. ebay has a rule that sellers must stand behind their products and that includes items that do not work. he can get banned for this so my guess is he will change his mind. More about refunds

The seller is not obligated to pay for the return shipping, although I'd certainly ask him for it.

Very important Joy - be sure you use delivery confirmation when you return it so that you have proof of delivery in case he claims he doesn't receive it back.

If you ended up returning it for an actual refund, they would have to return your ORIGINAL shipping charge.

As I mentioned in my email to you, XBox's are one of the biggest fraud items on ebay. I've seen lots of people sell Xboxes and then ship out nothing but an empty box or something broken.

I mean, you didn't buy it expecting it to be broken. If it were me as a seller, I would definitely give you the return shipping in a heartbeat just because it's the right thing to do (and for good customer relations).

and offer the shipping fee, especailly if he is still getting a sale out of it. from what I read you can still file a dispute. would it be worth it to meet 1/2 way and spilt the cost of shipping? He may be thinking that he has to pay shipping on the replacement so he is out that money but it is still not your fault the item doesnt work. perhaps to keep peace on both sides and level the playing field....the two of you could split the shipping cost to return the item back to the seller....that way the seller can see you are willing to try to work a reasonable compromise without each of you being out too much money....I think that is what I would do. 16|2|He emailed me today, and is paying $10 of the shipping! :) (it was $15.20 for large priority box with deliv confirmation) I am satisfied with that, he is a good seller, very quick to reply to my concern and gives clear instructions on how to ship the item.|saint6811|waylan@comcast.net|16:12:18|01/11/2010|
