My bf is 31 yrs old. He hurt his back a couple yrs ago on a construction job. Dr's say something about 10% (I'm not quite sure what exactly, I can't remember the exact term right now). He has trouble getting up in the morning, but once he starts moving around he seems better. He says he can't get a job that requires standing long periods of time....or any kind of heavy lifting. He isn't the smartest guy and doesn't have a degree. He says his back hurts everyday and I just don't realize how bad it is. My question is, would he qualify for any kind of social security disabilty? What does he have to do? Go to different Dr's and get their opinions? Did the employer file a claim with their insurance company?

He would likely get denied SSD. He's too young. What was the 3,000 bucks for? If it was for medical bills and not in full settlement, he may be able to go back on the previous employer. But you tossed out that 10% figure and that makes me think that is a rating - as in 10% the job and 90% not the job. Did he have back problems before he hurt his back a few years ago?

Has your boyfriend visited a doctor about this? They likely did MRIs or something of his back a few years ago. They'd take new ones and then compare to see if there were any changes. Has he been to Physical therapy? That can help his back. You did say it felt better after he moved around. In order to get SSD you would have a far better chance at getting any benefits if you had an official diagnosis. He should get to a doctor, have some tests and figure out what is wrong with his back and perhaps there is something the doctor can prescribe or have done to help alleviate his pain.

If his back is better after being out of bed for a while, why can't he work? Has he failed a pre-employment physical? There are jobs that do not require lifting or standing all day. Maybe he needs training, but surely there is something he can do. A $3000 settlement? That is not much, so he must have not proved it was a serious injury. 6|2|WAS THE DISABILITY ONLY 10%? The 10% would be his rated loss of use of his back. No, he would not be able to get Social Security because to get that, he would have to be unable to do any job in the US economy. My husband is 43, has a Traumatic Brain Injury and many physical injuries from a work accident 3-1/2 years ago and even he had a difficult time getting it. The $3,000 your guy received was to settle his claim based on the 10% loss of use. There has to be something non-physical he can do. The challenge will be to find it. If an injury is work-related, does it always have to be dealt with under work comp? Yes, workers' compensation has to be handled as just that. Health Insurance nor Medicare is going to get "stuck" paying workers' comp. responsibilities. What does DSS mean?
