They said the same thing to him about being liable for the difference, but after they took the truck, I don't think he ever heard another word from them about it.
We (we were living together at the time) told the bank that we couldn't afford it and told them to come get it....we were totally cooperative about it, but I guess they're so used to people avoiding them and pulling tricks that they sent some guys up in the middle of the night to get it. They were all prepared to break into it and take it by any means necessary, and they were EXTREMELY surprised when I went out to give them the keys....LOL. I think they expected me to come out toting a shot gun - I don't envy anyone doing the job of reposessor, that's for sure!
Anyway, if I recall, it was overall a pretty easy transaction although I'm sure it stayed on his credit for a long time.

I was married to my ex then and had moved from IL back to IN. No job, no money. We called the bank told them to come and get the vehicle and we had no money/car & would happily give the keys to it etc. They (repo people) came in the middle of the night, gun toting and all..scared the you-know-what out of us. I was reeally upset as they were NOT nice about it and I had already told them we would gladly give the keys etc..so not a nice experience.
Yes..you ARE liable for the balance due on the vehicle even if repo'd as you signed a contract with the bank so legally responsible for balance due. They will just sue you to get the balance etc even if you dont' have the money. 6|1|not only are you responsible for the remaining balance, but it will stay on your credit for at LEAST 7 years and up to 10............|pussecat|pu55ecat@aol.com|07:54:18|06/23/2009|
hubby had a repo in 1998 and it was charged off in 2003, they are STILL coming after him for the balance due. (in 1998 it was around 2k now they are saying nearly 8k) one thing on our side is the fact that over the years the paperwork has been lost, not only has the orginal paperwork disappeared but so have the charge off papers, thus, we are not liable according to the state of sc as there is no paperwork to back up the claims. the repo came off of his credit in the fall of 2005 but debt companies have until 2013 to "try" to get the $ out of him according to sc statue of limitations. for the balance owed you'll need to check your state's sol's but as for your credit report, it is the same nationwide. hth :)

in sc they had 3 years from the orginal repo date and then another 3 years from the charge off date to take hubby to court, they did not, thus he can not be taken to court anymore for the $. it is considered small claims being as the orginal amount due was less than $3,500 but these sol's also vary by state so you may want to check that out as well. hth

in sc when talking to the debt collecter's on the phone or via snail mail or email if you (the person who incurred the orginal contract) ever admits that he/she owes or owed the debt it starts the sol's all over again, thus if patrick were to say today that he owed the debt then the debt companies would have another 10 years starting from today to try to get the money. so be careful of this as well. hth

and just asked what you owe for it?
