My wages are being garnished by 25%. Over a hospital bill for my husband, that we have been trying to pay 10.00 and 20.00 to when we can.

I talked to my husbands lawyer, and she is sending a letter to social security, to request a hardship grant. Not sure whta it is. But if moves like disabilty, it will take for ever.

I just don't now how we are going to make it on 25%less. I am not posting much, but I am reading. Please know, if you are requesting prayers. That you are in my thoughts and prayers, even if I do not post. Donna

I believe you would have to sign a consent form w/your employer in order for anyone to garnish your wages.... Do you recall signing such a form? A business or collection agency can't just start taking a % of your paycheck - they would've had to 1st either file a court claim where the judge ordered the garnishment (you still have to sign a garnishment form) or sent you a "Voluntary Garnishment" type of form for you to sign & give to your employer. If the hospital sent you a "Voluntary Garnishment" type form & you didn't sign/return it, then they would HAVE to take you to court. Even then, it would have to be determined where you fit into the Federal Poverty Level. If you fall below the FPL, the judge would likely ask you what you could afford to pay a month towards the bill & he would take into consideration the payments you're already attempting to make. If it's only $10/month, then the hospital would have to accept it & all interest & late fees on the bill are to cease. Either way, your signed consent is a REQUIRED before your employer can take anything out of your wages. That's how it works here & since the FPL plays a part, I would think it would be that way in ALL states. So.... if the hospital just decided they were going to garnish your wages w/out taking any of 2 steps above 1st, I believe it would not be legal, & I would think your lawyer should already know that.

4|2|Our lawyer, is already trying to find out the garnishment came to be, through my employer. Work gave me no notice at all. I just got my check, and asked what the new deduction was, and they had me call payroll. Who explained it to me. My lawyer thinks me can the amount reduce. Here they want there copay before they treat you in ER or admit you to hospital. It is a shame because people just do not have that kind of money up front. The only time they do not want it is when it is a life threatening, then they will treat you in ER.
