I work/worked in a Federal HR dept... I can give you the FCR's on it, but your State can inact additional/size specific/etc.. regulations (which I may have, but would have to look)

Vicki, NY 8|2|Thanks vickie :) I am familiar with the laws/regulations on meal or rest breaks....was more concerned with whether or not they can dock a non-exempt salaried employee for partial day worked (based on duties, responsibilites)....I just learned that for the past 2 1/2 yrs I have been treated as an exempt salaried employee by my employer, but I do not qualify for that status according to FMLA and IDOL (Illinois DOL)....need to know if in regards to work days/hours worked if they can dock non-exempt salaried employees....I know they cant really dock exempt employees unless the time missed occurs due to illness.|saint6811|waylan@comcast.net|12:04:17|10/24/2008|

Also was looking for info on regulations regarding consistency in paid holidays for salaried employees regardless of exempt or non-exempt status....in otherwords, if I am not granted 7 paid holidays off as a non-exempt employee, would they be required to pay me double time holiday pay for holidays worked as they do hourly non-exempt employees??

I did a quickie search and the infor was tough to find, but if you have your state's BOLI office phone number, you might try just calling them and asking for the info over the phone?

Wish I could help, but I couldn't even pinpoint what number you could call.

OK this isn't everything... and its really crappy reading... I can't help you with your state I don't have anything from there... but Federal Law I know inside out :) just a note that remember there may be State law that I don't know and could supercede this info... I am not back to work until Tuesday but I'll check out my books there when I go back:

As for this, if you worked for me in the Fed world, you do NOT have to work the holiday, but you still get paid for it. So for example, your schedule is Mon-Fri. Christmas falls on Saturday, then you would get the Friday before it off and paid... If you worked Friday then you would get double time. Doesn't matter if you are exempt/non-exempt thats a mute point.

I've never worked in private industry, but if you have really specific questions and the Federal end will help, I can give you my number at work next week and you can call and we can work it out... I have an amazing group of people I work with including a Civilian Pay Specialist who could help get you answers :)

The changes did include the two part test to determine if someone qualifies to be classified as exempt...I keep seeing older articles online that state 'proposed' for 2004, but wasnt able to find if they were actually enacted. ETA: If those proposed changes were made, did each state have to incorporate them? I am asking because the info I found would make me ineligible for exempt status based on the Learned Professional definitions as part of the two part test....I am an LPN and I did find a paragraph that specifically notes LPN's or LVN's as ineligible.

Best guess not having any of my books in front of me is Labor Code 227.3 I'm pretty sure thats the one that has to do with holiday/vacation. But I know its in the 200's...

As for current edition of the Labor Code, I don't know... I'm sure I have the current edition at work, but I'm not going to be back until Tuesday...

Could you email me (if your ok with it) the specific details you are looking for... It will make it easier for me to search. I know there are questions on holiday pay, but it sounded like there may be a question on vacation/time off... I'm not sure are you full time or part time? Are there shift differential problems to? Sorry I read your posts and have vacation brain,,, I need things spelled out for me lol...

I'll try and search it out for you, but if I can't find it, I'll email you my number at work and you are more than welcome to call me there...
