I've been trying to help my son with a big problem this past week. His apt complex is doing a total renovation and they told the tenants who wanted to stay that they would give them a moving credit in appreciation for that. He is the only apt in his unit that's left. There are about 30 buildings in all. They removed the central air units from all the apts and gave him this little window unit that wouldn't cool a cat closet. Well, he's not there that much so he was dealing with that. Then there was a big rain and water came down from the open apt above and even through the central air vents on the walls. His living room ceiling almost came down and the carpets were soaked.

These maintenance people come and tell him they'll be moving him on the 9th so just hold on. Hold on????! His apt was flooded and they tell him to hold on. He moved most of his good stuff out to our house but his apt is still (in my opinion) unlivable. I told him to take pictures of the whole mess and we could try to find some way to deal with these people. Looks like every attorney we contacted about a lawsuit just does personal injury. So, we're trying to find out what we can do. The apt management office won't even give the name of the corporation who owns the apts.

I'm trying to help him during the day while he's at work but I haven't come up with much yet. This is really frustrating. The fact that they think he should just put up with this garbage! Sorry to be so long-winded. If you know of anyone who has ever had this type problem or have any idea what we should do next, please post. Thanks VERY much!

then I think he is entitled to withhold rent. I would check on that with your tenant/landlord laws for your state as they vary. You are right that he should document it as he may need to go to court with this issue.

does landlord/tenant law. That is a specialty section, check with your state bar association ot www.lawyers.com to find one near you.

But, it varies from state to state. I know that when we had problems in our former apartment, I did a lot of research on what our rights were as tenants.

It was no fun when we had raw sewerage backing up into our basement (twice in a month) and there is nothing your landlord will do about it for days. You learn very quickly what your options are when a situation like that occurs.

Just as Mary asked in a previous post.
Thats one thing I will give to my son....all 3 places that he has lived since he moved out....Hes always had renters Ins.

The inspector or code enforcement officer, depending on your town, has the ability to put cease and desist orders on anyone who violates code. They can condemn the building etc as well. I know that doesn't get your son his $$ back but once a cease and desist order is on a property, lease argreements are usually voided. Then your son can pursue his claim in the court system.

going to see a lawyer Friday. I decided I'd spring for the charges just to get things going. That's what "dear old Dads" are good for, right? lol It just makes me really mad that they have this attitude. I even went over to the rental office before my son came home from work, thinking I could be the calm voice of reason---NOT!! Before I knew it, I was losing my temper with the manager.

She flat out refused to tell me who the company was that had responsibility for the buildings. "And if you want to vent, Mr. Brown, you need to go outside and talk to the contractors. They're the only ones you need to know about!". I think she thought I was the Mr. Brown who lived in the apt! I told her I was through talking to "hired help" who had no authority to do anything more important than answer a telephone. I mean she's sitting there in a very cool office with a super nasty attitude while my kid's apt is boiling hot--and it was 100 degrees here today. I think if she'd been a man I'd have asked her to step outside for a fight!! LOL

Anyway, I talked to a friend who recommended a lawyer specializing in landlord/tenant disputes. I've set up an appt to see her Friday after my son gets off work. We have pictures of the whole mess the rain made and that should help. I even took a picture of that poor excuse for an air conditioner they gave him. I'm not going to let this go. Even if we don't come out on top, it'll make them think twice before they try to take advantage of someone else.

If you search for the complex, it should say who owns it. I would then contact their corporate office and even threaten to go to one of the local news stations that does problem solvers or things like that. Major flooding can lead to all sorts of health problems including the development of toxic mold in apartments. They should have at least provided fans to help the area dry.

first if he is still paying rent i would take it down to the court house and put it in escrow this way the courts see he is paying his rent on time but not to them til they correct the problem ..2. it is illegal for them to with hold the information on who owns the building but if you go to the county auditoes website in that county and put in the manger office addy it will bring the property up and tell you who owns it from there .. then i would call the fire department in to see if it is a fire hazard then i would call the building inspector in let them see if it is even safe to live in then the health department while at all time document everything you do time date who you talk to who came to the apartment etc ... if he cant affrod an attroney tell him to go to legal aid they eat this kind of thing up .. but there should be an attroney out there that will take it .. just have to keep looking .. and if in the end all this dont work call the NEWSPAPER or SEE IF ONE OF YOUR LOCAL NEWS HAS A MAN THAT HELPS PEOPLE OUT WHEN THERE GETTING RIPPED OFF .. HOPE THIS HELPS
