phases out at MAGI of 125k for single and 225k for married. If married it checks the qualifications of BOTH spouses.

Also, this seems to be one that can again be TREATED retroactively. Assuming you buy in the correct time frame Nov 6, 2009 or whatever day it was signed...up to April 30, 2010.... unless you have a binding contract by April 30 but have not "purchased it yet" then you have till June, I believe. And you can elect to amend your previous year's return in order to get the money earlier or because you know your AGI qualifies.
